THE DEMPSTER’S BREAD TAKE THE HEALTHY ROUTE CONTEST OFFICIAL CONTEST RULES AND REGULATIONS (“RULES”)

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS CONTEST IS SUBJECT TO ALL APPLICABLE FEDERAL, PROVINCIAL/TERRITORIAL AND MUNICIPAL LAWS AND REGULATIONS

This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter. You understandthat you are providing your information to the Sponsors and not to Facebook or Twitter. The information you provide will only be used for the administration of this Contest and in accordance with the Sponsors’ privacy policy (see below). Facebook and Twitter are completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Facebook or Twitter. You may only use one (1) Facebook account and one (1) Twitter account to participate in this Contest.

CONTEST PERIOD
The Dempster’s Bread Take the Healthy Route Contest (the “Contest”) begins on January 7, 2016 at 12:00:01 a.m. Eastern Time (“ET”) and ends on February 15, 2016 at 11:59:59 p.m. ET (the “Contest Period”).

ELIGIBILITY

The Contest is only open to legal residents of Canada (excluding Quebec) who have reached the age of majority in their respective province/territory at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Canada Bread Company, Limited (the “Sponsor”), its parent companies, subsidiaries, affiliates, distributors, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Released Parties”). By participating in this Contest, you agree to be legally bound by the terms and conditions of these Official Contest Rules and Regulations (the “Rules”). Sponsor shall have the right to require proof of identity or eligibility to participate in the Contest.

HOW TO ENTER:
NO PURCHASE NECESSARY. There are two (2) ways to enter the Contest, as follows:

Purchase Entry:

Main Entries: To enter, visit dempsters.ca (the “Website”) and follow the online instructions to create an account, by (i) entering your full name, province, email address and telephone number in the space provided; and (ii) confirming that you have read and agree to be legally bound by the terms and conditions set out in these Rules. Please note that you will not receive any Contest entries for the act of creating an account (the “Account”). Next, visit a retailer in Canada that sells Dempster’s products and purchase a specially marked “Take the Healthy Route” Dempster’s Whole Grain, Smart and/or Thins Participating Product in order to receive a unique 12-character entry code (PIN) code affixed to the packaging (the “PIN”). At any time before the end of the Contest Period, you may return to the Website and access your Account to submit a unique PIN. Each unique PIN that you submit will receive ten (10) Entries (the “Main Entry Method”). To be eligible, all Entries must be submitted and received within the Contest Period in accordance with these Rules.

Bonus Entries: After you submit a unique 12-character entry code (PIN) and participate in the Contest using the Main Entry Method, you will have the opportunity to earn Bonus Entries (defined below), as follows:

Bonus entries accumulated using the Facebook Entry Method, the Email Entry Method, the Twitter Entry Method, the Newsletter Entry Method, and the Email Notification Entry Method are collectively “Bonus Entries” and each a “Bonus Entry.” To be eligible, all Bonus Entries must be submitted and received within the Contest Period in accordance with these Rules.

No Purchase Entry: To enter this Contest without making a purchase, an eligible entrant must submit a handwritten letter which contains the following information: (i) the date, his/her name, address, city, province or territory, postal code, telephone number and email address, (ii) the words “Dempster’s Bread Take the Healthy Route Contest”, and (iii) a unique and original essay of at least 50 words on “how Dempster’s helps me take the healthy route” (a “Mail-in Request”). Mailin Requests must be mailed to Dempster’s Bread Take the Healthy Route Contest, PO Box 4099, Paris, ON, N3L 3W9. Mail-in Requests must be postmarked during the Contest Period, and only those received by February 15, 2016 will be eligible. No mechanical reproductions permitted. Mail-in Requests become the property of the Sponsor and will not be returned. If an eligible Mail-in Request is received, the applicable eligible entrant that submitted such Mail-in Request will be provided with one (1) Entry to the Contest, and an email will be sent to the eligible entrant to confirm that their Mail-in Request has been received and an Entry has been submitted into the Contest on their behalf. There is no limit to the number of Mail-in Requests that may be made by an entrant; however each Mail-in Request must be mailed in a separate envelope bearing sufficient postage.

Main Entries and Bonus Entries are collectively referred to as “Entries” and each, an “Entry.”

Minimum Browser Requirements:

ENTRY LIMIT:

There is no limit to the number of Purchase Entries or No Purchase Entries an entrant can receive, in accordance with these Rules, except in the case of the Twitter Entry Method, in which case there is a limit of one (1) Entry per day during the Contest Period, and in the case of the Newsletter Entry Method, in which case there is a limit of one (1) Entry during the Contest Period, and in the case of the Email Notification Entry Method, in which case there is a limit of one (1) Entry during the Contest Period. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain an Entry (regardless of the method of entry) other than as permitted in accordance with these Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Released Parties are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).

VERIFICATION:

All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

THE PRIZE:

There will be one (1) Grand Prize (the “Grand Prize”) available to be won consisting of the confirmed Grand Prize winner’s choice of one (1) of the following Grand Prize options (each a “Grand Prize Option”):

The total approximate retail value of each Grand Prize Option is twenty thousand Canadian dollars ($20,000.00 CDN) based on a Vancouver departure, although the actual retail value may vary depending on the point of departure, as well as fuel prices, time of year and other factors. Under no circumstances whatsoever will any difference between the actual and approximate retail values be awarded. Choice of flights, airline(s), hotel accommodations (including, without limitation, room size and occupancy), travel dates, and all other aspects of each Grand Prize Option are at the sole and absolute discretion of the Sponsor. Blackout dates apply.

Without limiting the generality of the foregoing, the following general conditions apply to the Grand Prize: (i) the Grand Prize must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (ii) no substitutions may be made to the Grand Prize, except at the Sponsors’ option; (iii) all travel related to the Grand Prize must take place within one (1) year of Grand Prize notification, otherwise the Grand Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place; (iv) the confirmed Grand Prize winner and his/her travel companion must: (a) travel on the same itinerary; (b) have all necessary documentation to permit international travel (including, without limitation, any passport, visa and/or other requirements for international travel), if applicable; and (c) not have any barrier to entry into any country involved in the Grand Prize and/or re-entry into Canada, if applicable; (v) any additional costs not specifically and expressly stated above as included in the Grand Prize are the sole and absolute responsibility of the confirmed Grand Prize winner and his/her and travel companion, including, without limitation: additional meals and drinks; gratuities; entertainment; health and travel insurance; transportation for the confirmed Grand Prize winner and his/her travel companion to and from the Canadian airport selected by the Sponsor; additional transportation; baggage and other fees; and items of a personal nature (NOTE: the confirmed Grand Prize winner and/or his/her travel companion must present a valid major credit card at the time of hotel reservation as per policy to cover cancellation and any incidental expenses); (vi) if the confirmed Grand Prize winner and/or his/her travel companion does not utilize any part(s) of the Grand Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) the Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsors’ sole discretion, a cash award; (viii) all travel arrangements relating to the Grand Prize must be made through the Sponsor or its designated agents; (ix) by accepting the Grand Prize, the confirmed Grand Prize winner agrees to waive all recourse against the Released Parties if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part; and (x) the confirmed Grand Prize winner’s travel companion must: (a) either be of the legal age of majority in his/her province/territory of residence or have the express written consent (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed Grand Prize winner on the Grand Prize trip; and (b) sign (and have his/her parent/legal guardian if he/she is under the legal age of majority in his/her jurisdiction of residence) and return the Sponsor’s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Released Parties relating to his/her participation in the Grand Prize (including, without limitation, any travel related thereto).

WINNER SELECTION PROCESS:

On February 18, 2016, (the “Draw Date”) in Brantford, ON, at approximately 10:00 a.m. ET, one (1) eligible entrant will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules during the Contest Period. The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.

WINNER NOTIFICATION PROCESS:

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the selected entrant (using the information provided on the entry form) within five (5) business days of the Draw Date. If the selected entrant cannot be contacted within five (5) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted and received in accordance with these Rules during the Contest Period (in which case the foregoing provisions of this section shall apply to such newly selected entrant).

WINNER CONFIRMATION PROCESS:

BEFORE BEING DECLARED THE CONFIRMED GRAND PRIZE WINNER, the selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return, within five (5) business days of receipt, the Sponsor’s declaration and release form which, among other things: (i) confirms the selected entrant’s compliance with these Rules; (ii) acknowledges the selected entrant’s acceptance of the Grand Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof; and (iv) includes the selected entrant’s consent to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the Internet. If the selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the Grand Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted and received in accordance with these Rules during the Contest Period (in which case the foregoing provisions of this section shall apply to such newly selected entrant).

GENERAL CONDITIONS:

All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Released Parties will not be liable for: (i) any failure of the Website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.

In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to deem the Entry to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an Internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the Entry in question.

The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://www.canadabread.com/?privacy). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
